Overview
Many disputes can be settled with a well-drafted legal notice, and many future disputes can be avoided with a well-drafted agreement. A notice also sets the record straight for any litigation that follows.
For cheque dishonour, the demand notice under Section 138 of the Negotiable Instruments Act must be sent within 30 days of receiving information of dishonour. Missing this window can defeat the case.

How a matter proceeds
Frequently asked questions
Is a legal notice compulsory before filing a case?
Not always, but it is required in some cases, such as Section 138 NI Act complaints and suits against the government (Section 80 CPC). In other cases it is often useful.
Should a rent agreement be registered?
A lease for more than eleven months generally needs to be registered and stamped. Unregistered agreements may not be admissible to prove the terms of the lease.
What if the other side ignores my notice?
You can then take the matter to the appropriate forum. The notice and the lack of a reply become part of the record.
