Under Article 226 of the Constitution of India, every High Court can issue directions, orders or writs to any person or authority, including the government, to enforce fundamental rights and "for any other purpose". It is the most common route to challenge government action before the Rajasthan High Court.
The five writs
- Mandamus directs a public authority to perform a legal duty it has failed to perform, such as deciding a representation or releasing pension.
- Certiorari quashes an order passed without jurisdiction, in breach of natural justice or with an error apparent on the record.
- Prohibition stops a lower court or tribunal from acting beyond its jurisdiction.
- Habeas corpus requires a detained person to be produced before the court so the legality of the detention can be examined.
- Quo warranto asks a person to show by what authority they hold a public office.
Who can be a respondent?
Writs lie against the "State" and its instrumentalities: government departments, statutory bodies, public sector undertakings, recruitment commissions and boards, universities and, in some cases, private bodies performing public functions.
When should a writ be filed?
Delay and laches
There is no fixed limitation period for a writ, but unexplained delay can be fatal. As a working rule, approach the court as soon as the cause arises and explain any delay in the petition.
Alternative remedy
If the law provides an effective alternative remedy, such as an appeal or a tribunal, the High Court usually expects it to be used first. Exceptions include violation of fundamental rights, breach of natural justice and orders passed wholly without jurisdiction.
Representation first
In service and administrative matters, a reasoned representation to the competent authority before filing strengthens the petition and often leads to a direction for a time-bound decision.
What happens after filing?
- The petition is listed for admission, and notice is issued to the respondents if the court finds a case.
- Interim relief, such as a stay, may be granted at this stage.
- The respondents file a reply, and the petitioner may file a rejoinder.
- The matter is heard and decided. An intra-court special appeal against a single-bench judgment generally lies within 30 days.
Documents to keep ready: the impugned order, your representation and any reply, the relevant rules or circulars, and proof of dates.
